2. Purpose and Scope of Application
These General Terms and Conditions govern all services provided by Navi-Tour SARL, in particular:
tourist cruises
catering on board
organisation of events and entertainment
private hire of boats
They apply to any reservation made by a customer, whether private or professional.
Any reservation implies full acceptance of these General Terms and Conditions.

3. Formation of the Contract
The contract is considered concluded upon:
confirmation of the reservation by Navi-Tour SARL and receipt of payment or the required deposit.
Navi-Tour SARL reserves the right to refuse any reservation for legitimate reasons, in particular:
previous disputes
non-payment
inappropriate behaviour

4. Prices and Price Adjustments
Prices are stated in euros including all taxes (VAT included).
Navi-Tour SARL reserves the right to modify its prices up to 20 days before the service in exceptional circumstances, in particular:
significant increase in fuel costs
increase in raw material prices
changes in taxes or charges
The customer will be informed as soon as possible and may:
accept the change
or cancel the reservation free of charge in the event of a significant increase

5. Payment Terms
5.1 Private Customers
Unless otherwise agreed, full payment is required before the service.
5.2 Groups and Private Hire (from 40 persons)
deposit upon reservation
second deposit 30 days before the event
balance due 10 days before the event
5.3 Late Payment (Business Customers)
In accordance with Luxembourg legislation on payment terms:
late payment interest is automatically due
a fixed recovery fee may be charged

6. Right of Withdrawal (Consumers)
In accordance with European Directive 2011/83/EU and Luxembourg law, the 14-day withdrawal right does not apply to leisure services provided on a specific date or during a specific period.
The services offered by Navi-Tour SARL fall within this exception.

7. Cancellation Conditions
7.1 Individual Customers
In the event of cancellation, the following fees apply:
90 to 60 days: 25%
59 to 30 days: 50%
29 to 11 days: 75%
Between 10 days and 48 hours: postponement or voucher valid for 12 months
Less than 48 hours or no-show: full amount due
7.2 Groups from 40 Persons
In the event of cancellation, the following fees apply:
90 to 60 days: 25%
59 to 30 days: 50%
29 to 15 days: 75%
less than 14 days: 100%
These amounts constitute fixed compensation proportionate to the damage suffered.
7.3 Special Cases
In the event of serious circumstances affecting the customer (e.g. serious illness, death), a commercial solution may be offered upon presentation of supporting documents, without legal obligation for the company.

8. Performance of Services
Navi-Tour SARL undertakes to provide the services in accordance with the reservation.
However, adjustments may be necessary for reasons beyond its control, in particular:
weather conditions
water level or condition of the river
technical constraints or administrative decisions
These changes do not entitle the customer to compensation, except in the event of total cancellation of the service.
Docking at locations other than Remich is charged additionally.
For private hire of a boat, a minimum of 40 persons is required. Below this minimum, €45 per missing person will be charged.

9. Force Majeure
Navi-Tour SARL shall not be held liable in cases of force majeure, defined as an unforeseeable, unavoidable and external event, in particular:
severe weather
flooding
fire
administrative decisions
health crises
This entitles the customer to a reduction of the basic private hire price of a maximum of 25% (if the deposit and quotation have been signed).

10. Safety and Conduct
10.1 Safety
It is strictly forbidden to bring dangerous, flammable or illegal products on board.
10.2 Conduct
Navi-Tour SARL reserves the right to refuse access to or remove any person whose behaviour compromises safety or the proper conduct of the service, particularly persons under the influence of alcohol or other substances.
In such cases, no refund shall be due unless otherwise required by law.

11. Liability
11.1 Company Liability
Navi-Tour SARL’s liability is limited to proven direct damages, except in cases of gross negligence or wilful misconduct.
11.2 Personal Belongings
Navi-Tour SARL shall not be liable for loss, theft or damage to personal belongings unless fault is proven.

12. Customer Obligations
Customers undertake to:
arrive at least 15 minutes before departure for boarding
comply with safety instructions
behave appropriately
Any damage caused shall be charged to the responsible customer.

13. Personal Data (GDPR)
Personal data is processed in accordance with Regulation (EU) 2016/679 (GDPR).
The customer has the following rights:
access
rectification
deletion
objection

14. External Providers and Equipment
Any use of external equipment is subject to prior authorisation.
The customer remains responsible for their equipment and for any damage caused.
14.01 Your DJs and Artists
If you wish to use your own artist/DJ or external services such as a Photo Booth, technical fees of €100 will be charged.
14.02 Your External Furniture
For furniture not belonging to the boat, moving and rearrangement fees apply:
€550 per area (lower decks)
€400 per area (upper decks)

15. Catering
Private hire of a boat is mandatory together with the selection of a meal and beverages.
Bringing external food or drinks is prohibited without prior approval
Choices must be confirmed 14 days in advance
The final number of participants is fixed 10 days in advance and serves as the billing basis

16. Cleaning and Damages
Any cleaning or damage will be invoiced additionally based on actual costs, for example:
Stains on carpets, chairs, flower petals, confetti, banners, rice, candles, sickness, curtains, cigarettes, etc.
Cleaning: €50/hour
Repairs: upon quotation

17. Exceptional Health Situation
In the event of cancellation due to administrative or health measures preventing the service, Navi-Tour SARL will offer:
postponement
voucher
refund less any actual costs incurred

18. Complaints
Any complaint must be submitted in writing within a reasonable time after the service, ideally within 8 days.

19. Applicable Law and Jurisdiction
These General Terms and Conditions are governed by Luxembourg law.
In the event of dispute:
for business customers: courts of Luxembourg
for consumers: courts of the customer’s place of residence in accordance with applicable law
The customer may also use an out-of-court dispute resolution procedure.
